CJM DIRECTS CRIME BRANCH TO PROBE INTO MATTER AGAINST SEPARATIST LEADER GEELANI
The Chief Judicial Magistrate (CJM) of Jammu SR Gandhi on Wednesday directed SSP Crime Branch to conduct preliminary enquiry to ascertain whether cognisable offence is found committed by separatist leader Syed Ali Shah Geelani
or not; and if so, then register FIR and investigate the matter.
Talking exclusively to NWS in Jammu on Thursday a lawyer Parimoksh Seth said, “A criminal complaint was filed against Kashmir separatist leader Syed Ali Shah Geelani following his controversial statement saying ‘the polemic issue of Kashmir can only be resolved using guns’.”
The complaint has been filed by Ravinder Kumar Raina, President Bhartiya Janta Yuva Morcha, a youth wing of BJP. Senior Advocate Sunil Sethi assisted by advocate Parimoksh Seth appeared for the complainant.
Court has passed directive, saying ‘instant complaint has been presented by the Ld. Counsel for the complainant seeking direction for the registration of FIR for the alleged commission of offences under sections 124 A, 153, 153-A, 153-B of the RPC.’
The perusal of complaint indicates the necessity for a preliminary enquiry only to ascertain whether cognizable is disclosed or not.
The complaint added that the utterances made by separatist leader are also punishable offence under section 153 as these were made with clear intention to disturb communal harmony.
“The statement of Geelani is also punishable under section 153-B RPC as the statement is prejudicial to the maintenance of the harmony and thus the complainants sought direction to the Crime Branch Jammu for registering FIR against Geelani under sections 124-A, 153, 153-A and 153-B RPC,” said Seth.
