SUPREME COURT ORDERS EXCLUSION OF JAT FROM OBC RESERVATION LIST
New Delhi : Supreme Court has quashed the JAT community’s reservation under the OBC Category in the Central List. The inclusion of Jats in the OBC List was implemented by the then UPA Government which was followed by the acceptance of NDA Government in August 2014.
A petition filed by the OBC Reservation Raksha Samiti to exclude Jats from the OBC reservation list in which the petitioner stated that the notification came by the then Central Government just an eve before the implementation of Moral Code of Conduct in that general elections. This move of the UPA Government was merely to convince the Jat voters who holds the prominent status in the politics.
Petitioners alleged that the UPA Government ignored the recommendation of NCBC (National Commission for Backward) which stated that Jats are not economically or socially backward and should not be entitled for any such reservation.
A bench comprising justice Rohinton F. Nariman and Justice Tarun Gogoi said that we quash the notification issued by the UPA Government regarding the inclusion of Jats in the Central List of OBC(Other Backward Classes). The wrong inclusion of a politically organized Caste like Jat might lead to the adverse impact on the other caste listed in the OBC List. Bench added that there should not be the inclusion of Caste in the OBC List but exclusion also needs to be done over the period based on the performance by the listed Castes.
Bhupinder Singh Hooda said, “Central Government should appeal against this verdict in the higher bench in the Supreme Court .”
Choudhary Virender Singh said , “Jat community should be given reservation under the OBC since Yadavs and Gujjars who are similar to Jats are availing the benefits of the OBC reservation throughout the country”.
